SUMMARY FINAL JUDGMENT
THIS CAUSE having come on to be heard upon the Defendants,
ROBERT GARY GOODMAN and PROGRESSIVE CASUALTY INSURANCE COMPANY'S
Motion for Summary Judgment on the issue of indemnity and the De-
fendants, DOLLAR RENT A CAR SYSTEMS, INC. and NATIONAL UNION FIRE
INSURANCE COMPANY'S Counter-Motion for Summary Judgment on the claim
of indemnity and the Court having heard argument of counsel and be-
ing otherwise advised in the premises, it is hereby
ORDERED AND ADJUDGED:

1. That the Defendants, DOLLAR RENT A CAR SYSTEMS, INC. and
~ NATIONAL UNION FIRE INSURANCE COMPANY'S Motion for Summary Judgment
is denied.

~ 2. That the Court finds as a matter of law that the release
given by DOLLAR RENT A CAR SYSTEMS, INC. to ROBERT GARY GOODMAN on
June 6, 1979 fully releases ROBERT GARY GOODMAN from any claim for
indemnity arising out of the automobile accident herein.
3. Summary Final Judgment is hereby Ordered and Adjudged in
favor of ROBERT GARY GOODMAN and PROGRESSIVE CASUALTY INSURANCE
~ COMPANY on the indemnity claim of DOLLAR RENT A CAR SYSTEMS, INC.
and that claim is dismissed as a matter of law. The Court retains "

jurisdiction to tax costs on~that claim.
