MODIFICATION AND E)CPIIdSION OF NOTE AND MOR'PGAGE -
THIS MODIFICATION AND EX'InV.SION OF NOTE AND M'JRTGAGE entered
into as of this day of Q c~ab• r 1980, by and among AQIA RAB~II~IA,
INC . , a Florida corporation, AQUA RABEIIA A.S.90C7ATES, a Florida partner-
ship, AQUA RA, INC., a Florida corporation (hereinafter sometimes
collectively referred to as "Mortgagors"), and RYDER REALTY, INC.,
a Florida corporation;
WITNESSETH, that:
inhiEREAS, RYI3ER REALTY, INC. is the owner and holder of a certain
Nbrtgage executed by AQUA RABEIZ,A, INC. and AQUA RABELLA ASSOCIATES in fawn
of WI1~MII~, V'ILi~S OF AMERICA, INC. recorded in Official Records Book
204, at Page 116, and a certain Nbrtgage from AQUA RA, INC. and AQUA RABII~IA
ASSOCIAZ'F5, recorded in Official Records Book 204, at Page 101, both of
which Nbrtgages mere consolidated by Mxlification and Oonsolidation
Agresr~nt recorded at Official Records Book 238, at Page 1953 all of the
.Public Records of St. Lucie Oounty, Florida, encumbering the property
described at F~d~ibit "A" attached hereto and made a part hereof, said
ownership being evidenced by certain Assignments of Nbrt~gage from WIl~IILL
~~i VII~~GE.S OF AMERICA, INC. to RYDER REALTY, III. recorded in Official
Records Book 329, at Page 1069 and Official Records Book 329, at Page 1067
~ of the Public Records of St. Lucie County, Florida; and
i 4~O;RE~,S, AQUA RABF~~I.A, INC. and AQ(.~ RAB~Ei~tA AS.90CIATES have
~ requested that part of the foregoing property described at Exhibit "B"
~ attached hereto and made a part hereof, be released and have further
requested an extension anr3 modification of the obligations secured
by said Mortgages;
