CASE N0: 79-1233-FR IN RE: The Marriage of CINDY LEE SZALAY, Wife, and EUGENE J. SZALAY, Husband - ~ O R D E R f THIS CAUSE having come before the Court upon the Wife's Motion for Modification of Final Judgment, Contempt and Notice, as amended, ' t the Court having heard the testimony of the parties, the argument of counsel and being otherwise fully advised in the premises, finds that ~ t there are ambiguities in the Property Settlement Agreement entered by the parties and incorporated in their Final Judgment Dissolution of Marriage of November 21, 1979. It is, therefore, ORDERED AND ADJUDGED as follows: s 1. That the Husband shall have exclusive possession and ~ control of the marital home of the parties for a period of two (2) years, commencing October 7, 1980. I' 2. That, at the conclusion of the aforementioned two-year ~ f period, the house shall be listed for sale on the open market for a } { price equivalent to $58,000.00 in 1980 dollars, or such other price ~ as mutually agreed upon by the parties. That the Husband shall f x continue in exclusive possession and control of said marital home until it is sold and, upon the sale of said home, the net proceeds shall be equally divided between the parties. 3 3. That the Husband shall pay the Wife the sum of $200.00 to reimburse the Wife for maintenance expenses paid by the Wife during ! her occupancy of the marital home. 4. That the Husband shall reimburse the Wife for those medical ex enses she has aid for the medical care of the minor children of ~ P P i the parties subsequent to the dissolution of marriage, said sum being approximately $209.00 BO~OIR(~~ P~t~ s s ~ , - -
