THIS CAUSE having come on to be heard upon the Motion to

Dismiss filed on behalf of the Third Party Defendants, FRENZ
ENTERPRISES, INC. and WILLIAM H. AMES, and this Court having
considered the merits of said Motion, having entertained oral
argument of counsel in support of their respective positions,
and having otherwise been fully advised in the premises, it is,
ORDERED AND ADJUDGED,
(1) As pertains to the Third Party Defendant, FRENZ
(
~ ENTERPRISES, INC., their portion of the Motion to Dismiss is
hereby granted, and the Third Party Complaint for contribution
filed by Florida East Coast Railway Company as against Frenz
Enterprises, Inc. is hereby dismissed with prejudice.
(2) As pertains to the Third Party Defendant, WILLIAM H.
AMES, his portion of the Motion to Dismiss is also granted, but
without prejudice. Third Party Plaintiff, FLORIDA EAST COAST
