DEPAR1f1ENT OF HEALTH AND REHABILITATIVE CASE N0. 80-636-FR SERVICES OF THE S?ATE OF FLORIDA. etc., Petitioner, -vs- ORDER OF CONTEl~T KEVIN JOSEPH BURNS 1 Respondent. / s i THIS CIWSE ws heard oa t 3, 198n .upon the Motion for Baforcesient and Contempt previously filed herein by the Petitioner, and the ~ Respondent havinj not been present in open court in person, and the Petitioner having been preaeat in open court in person and represented by counsel, and the Court having heard all of the testimony of the parties and being fully advised ~ in the pieaises, it is therefore ADJUDGED that the Respondent, KEVIN JOSEPH BURNS , is guilty of willful contempt of this Court for failure to pay child support payments in the amount of $ 375.00 ,amount due as of ~entemher 25, 1980 , and he is adjud~sd in contempt of this Court and it is ORDERID AND ADJUDGED that as punishment for his contempt the Respondent ~ shall be coafined in the St. Lucie County Jail, Fort Pierce, Florida, for a period of 30 days, that the sentence of contempt is~suspended until JANUARY 2. 1981 conditioned upon the Respondent paying to the Clerk of Circuit Court of this county on of before JANUARY 2, 1981 , the sum of $ 375.00 ,plus 52.00 statutory fee. Upon the failure of the Respondent to make paywent in full of the aforesaid i amount on or before JANiTAAY 2, 1981 ,you and your duly authorized deputies are therefore and ~ ALL AND SINGULAR OF THE SHERIFFS OF THE S?ATE OF FLORIDA are ordered to take into custody the above-named R~espondent•as soon as he can be found and deliver him to the Sheriff of St. Lucie County, Florida, for the execution of the above descr`..~~ judgment and sentence. The Clerk of Circuit Court and thi• Court shall be prasptly notified of his arrest. It•is further _ ORDERED AID ADJUDG® that .the Clerk of Circuit Court-shall and he is s hereby ordered to forward said arrearage payments received from the Respondent i until the above arrearage is paid in full to the Department of Health and Rehabili- tative Services, Child Support Enforcement Section, 1317 Winewood Boulevard, Tallahassee, Florida, 32304. It is further ~ ORDERED AND ADJUDGED that the above arrearage payment shall be in addition to the regular support payment hereinbefore ordered by this Court and said paysent shall continue. Said regular support payment shall be sent by the Clerk of Circuit i Court to the Department of .Health and Rehabilitative Services unless a Notice has been or is filed by the Department directing acid payment to the custodial parent. It is further ~ ORDERED AND ADJUDGED that this order of contempt does not annul any prior order(s) of contempt or order(s) relating to support arrearages.
