HomeMy WebLinkAbout1632 pursuant to certain terms and conditions as set forth in the application for approval thereof as filed with the Court, and it further appearing to this Court that said order authorizing the sale and conveyance of said property to Unik Group Carp. and the application and contracts relevant thereto, contemplate develop- ment of the subject real property by Unik Group Corp., or its assigns, and not Ocean Park Association, Inc., and it further appearing that by virtue of said contemplated development by Unik Group Corp., the debtors and their creditors will ultimately benefit therefrom and will receive proceeds as a result thereof equal to or in excess of any development previously contemplated to be made or undertaken by Ocean Park Association, Incs, and it further appearing to this Court that in order to effectuate the transfer of title to said property from Ocean Park Association, Inc., to Unik Group Corp., and in order to clear .any clouds on the status of the title of said property, it is necessary to re- move any constraints or limitations on the use, development or transfer of said property which might be in effect or could now be construed to be in effect by virtue of the terms and condition i I of the original judgment entered herein on October 7, 1977, as amended by judgment entered hereby on March 22, 1979, except as provided for in this Court's judgment authorizing the sale of said property to Unik Group Corp. by order dated April Z8, 1980, I ~ and good cause appearing for the making of this order, IT IS, on this fC' u day of October, 1980, on motion of Lehman F, Wasserman, attorneys for the debtors herein, ORDERED, that this Court's judgment dated October 7, ~ 1977, as amended by judgment dated March_22, 1979, is hereby amended insofar that said judgments required or limited said prop s erty described therein to be developed by Ocean Park Association, ~3~~ P~1631 _ _ _ _ _ ~ • r.
