HomeMy WebLinkAbout1674 } ~ 1 r r 1 that, unless the context otherwise specifies or requires, the following terms shall have the meanings herein speci- f ied, such definitions to be applicable equally to the singular and plural forms of such tenas: Banker's Mort a e: the mortgage defined as such in the PreTi~nary tatement, as the same may be amended or modified from time to time. Club Facilities: the recreational facilities to be constructe on the Recreational Parcel in accordance with the Preliminary Site Plans. Construction Lender: any bank, savings institu- tion, trust company, national banking association, insurance company, pension trust, real estate investment trust, mortgage banker, mortgage broker or other institutional lender in the business_of making construction loans which loans money to Developer to f finance the construction of the Improvements, excluding any such lender affiliated with Developer. Collateral Mort a e: the mortgage defined as such in the Pre iminary Statement. Construction Mortgage: any' mortgage given to a Construction Lender to secure advances made to Developer to finance the construction of the Improvements. ~ _ Costa Znc.: the party def fined as such in the • first paragrap o t is Restated Mortgage, together with any successor thereto by way of merger, consolidation or acquisition of all or substantially all of its assets. ~ Costas: the parties defined as such in the first paragraph this Restated Mortgage, together with their respective heirs, executors, administrators and assigns. Develo er: the party defined as such in the first paragraph o this Restated Mortgage, together with any successor or successors to its right, title and interest in the Mortgaged Property, including at any time after the date hereof, the then owner of the fee of the Premises or the Improvements. Events of Default: the events and circumstances described as such n Section 6.01 hereof.
