(a) such proceedings shall suspend the collection thereof,
(b) no part of the Premises or any of the rents or profits
therefrom would be subject to loss, sale or forfeiture prior
to the determination of such contest, (c) Mortgagee would
not be subject to any criminal liability for failure to pay,
(d) Developer shall have furnished such security as may be
required in the proceedings or reasonably requested by
Mortgagee, (e) such proceedings shall not affect or prevent
the construction of the Project, and (f) Developer shall
notify Mortgagee of any such proceedings at which the amount
in contest exceeds $10,000 within ten (10) days after the
commencement thereof, and shall describe such proceedings in
reasonable detail. Developer will conduct all such contests
in good faith and with due diligence and will, promptly
after determination of any such contest, pay and discharge
all amounts which shall be determined to be payable therein.
(d) No Claims A ainst Mort a ee, etc. Nothing
in the Mortgage s a constitute any consent or request by
Mortgagee, express or implied, for the performance of any
labor or services or the furnishing of any materials or
other property in respect of the Mortgaged Property or any.
part thereof, nor as giving Mortgagors or Developer any
right, power or authority to contract for or permit the
performance of any labor or services or the furnishing of
any materials or other property in such fashion as would
permit the making of any claim against Mortgagee, in respect
thereof or any claim that any 1 ien based on the performance
of such labor or services or the furnishing of any such
materials or other property is prior to the lien of the
Mortgage.
3.08. (a) Insurance. Developer, at its expense,
will maintain or cause to be maintained, with financially
{ sound and reputable insurers, (i) during any period when
construction work is being performed on the Premises or any
~ portion thereof, Completed Value Builder's Risk Insurance
for the Improvements, including building materials on the
Premises, covering loss or damage from fire, 1 ightning,
extended coverage perils, vandalism and malicious mischief,
in an amount equal to not less than i00$ of the then Full
Insurable Value thereof ; ( ii ) with respect to any completed
Improvements, insurance against loss or damage by fire,
lightning, hail, explosion, riot, riot attending a strike,
civil commotion, aircraft, vehicle and smoke, and other such
risks, if any, as are from time to time included under
"extended coverage" policies, in amounts sufficient to .
prevent Developer or Mortgagee from becoming a co-insurer
_ under the applicable policies, and in any event in amounts
not less than 100$ of the then Full Insurable Value of -the
improvements as determined from time to time, at the expense
~ of Developer, by the insurer or insurers or by an expert
approved by Mortgagee; (iii) public liability insurance
~ against claims for bodily injury or death of persons and
~ damage to or destruction of property occurring on or about
the Premises and the adjoining streets and ways, in single
( limit amount not less than $1,000,000 for bodily injury or
death, and $100,000 for property damage; (iv) appropriate
workmen's compensation insurance in respect of any work on
