HomeMy WebLinkAbout1753 1 - ,I ~ - (c) Oceanview represents and warrants to Bankers that prior to the development of any portion of the Oceanview Property and the Lakeview Property it will } i secure a binding and enforceable agreement with Utility i - Company, a true copy of which-will be delivered to Bankers prior to the commencment of .any construction thereon, providing for an adequate supply of sewer treatment ~ capacity for the proposed development of the Oceanview Property with enforceable provisions, subject to the 'F customary contributions in aid of construction by the developer and applicable regulations, for the enlargement of the capacity of the existing-utility plant to accommodate the sewage needs of all remaining development contemplated upon the Oceanview Property and Oceanview represents and warrants that such agreement and all rights - thereunder will be coupled with an interest and will run with the Lakeview Property and Oceanview Property for the benefit of all subsequent owners thereof and be - enforceable by them and that it will not alter, cancel, waive or otherwise limit or amend its rights pursuant to said agreement or the nature of the agreement or cause-the same to be or become-in default without the same constituting a material default under the Oceanview - _ -22- - 342 P~~~1752 ME11fMON, lwM1/[11.
