It is agreed that the Sellers shall continue to be responsible for all Mortgage payments due GDV FINANCIAL CORPORATION, and to keep current in all respects those provisions as set forth in the Mortgage and Note due the said Mortgagee. In the event Sellers shall default in the performance of any of . their obligations thereunder, Buyers shall have the right to cure such default and to apply the full amount of any monies so paid to the reduction of the indebtedness due the Sellers under the terms of this Agreement. 12. The closing of the within transaction shall be at the offices of HAROLD E~. GOLDMAN, ESQUIRE, 8028 South Federal Highway, Port St. Lucie, Florida 33452, on or about November 17, 1980, at 10:00 A.M.. At the time of the closing Sellers shall be responsible for the documentary stamps necessary to be affixed to this Agreement, all real estate commissions, tax . prorations to the date of closing, closing fees and the payment and discharge of all liens on said property with the exception of the first mortgage hereinabove recited. Buyers shall be responsible for the payment of the recording of this Agreement, closing fees, and title insurance. 13. Sellers warrant that all built in appliances ~ plumbing, electrical and airconditioning shall be in working E; order at the time of the closing and the roof in good repair. ~ ~ i~ Buyers to pay for a termite inspection report and Sellers to pay l j~ the cost of any treatment deemed necessary by such report. ' 'e 14. All monies required to be paid herein shall {I~{ be payable in currency of the United States of America. I~ III 15. The Sellers expressly agree that they will not transfer, assign or otherwise convey the real property 4 !1 described in this Installment Sale Contract to any third party ~!!I I _ and will indemnify Buyers from any and all damages incurred by ~ Buyers for violation of this provision.
