DF.CLARA'tION OF CONDOMINIUM
OF
TARPON BAY YACHT CLUB CONDOMINIUM B
S.C.S. TARPON BAY, INC., a Florida corporation,
("Declarant"), for itself, its successors, grantees and assigns,
being the owner of the fee simple title to the real property in
St. Lucie County, Florida, more particularly described in Exhibit
"A" attached hereto and incorporated herein by reference (herein-
after referred to as the "Land), hereby submits the Land and the
improvements thereon in fee simple to condominium ownership
pursuant to the provisions of Chapter 718, Florida Statutes,
hereinafter referred to as the "Condominium Act", in existence as
of the date of this Declaration, upon the terms, conditions,
restrictions, reservatians and limitations hereinafter set forth.
NOW, THEREFORE, S.C.S. TARPON BA Y, INC. and HASCO TARPON BAY,
INC., both Florida corporations, a joint venture D/B/A TARPON BAY
(hereinafter "Developer), make the following declarations:
1. STATEMENT OF PURPOSE. The purpose of this Declaration
is to submit the Land .and the improvements thereon to the condo-
minium form of ownership and use in the manner provided in the
Condominium Act. Except where variances permitted by law appear
in this Declaration, in the exhibits attached hereto, or in lawful
amendments to any of them, the provisions of the Condominium Act,
as constituted on the date of this Declaration, including the
definitions therein contained, are adopted and included herein by
express reference. All restrictions, reservations, covenants,
conditions and easements contained herein shall constitute
covenants running with the land or equitable servitudes upon the
land, as the case may be, and shall rule perpetually unless
terminated as provided herein, and shall be binding upon all unit
owners. In consideration of receiving and by acceptance of a
grant, devise or mortgage, all grantees, devisees or mortgagees,
their heirs, personal representatives, successors and assigns, and
all parties claiming by, through or under such persons, ayree to
be bound by the provisions hereof, and all exhibits hereto. Both
j the burdens imposed and the benefits provided shall run with each
unit and the interests in common property appurtenant thereto, as
defined herein.
1.1 Name and Address. The name by which this
Condominium is to be known and identified is TARPOtt BAY YACHT i:LUB
~ CONDOMINIUM B, and its address is Tarpon Bay Yacht Club, 3100
Pruitt Road, Port St. Lucie, Florida.
~ 1.2 The Land. The legal description of the Land,
I which is hereby being submitted to condominium ownership, is
attached hereto as Exhibit "A" and incorporated herein by
reference.
2. DEFINITIONS. As used herein, in the exhibits attached
hereto, and in all amendments hereto, unless the context requires
otherwise:
2.1 P.ssessment means a share of the funds required
~ for the payment of common expenses, which from time to time is
assessed against the unit owners.

2.2 Association means TARPON BAY YACH`t CLUB
CONDOMINIUM B ASSOCIATION, INC., the entity responsible for the
operation of this Condominium, except to the extent limited
