HomeMy WebLinkAbout0483 Association is at-_tached hereto as Exhibit "D" and incorporated by reference herein. 2.3 =aQard of Directors means t:he representative body responsible for the masnagemenr. of the Condominium and business of t:he Association. 2.4 By-Laws means the By-Laws of the Association, as they exist from time to time. A copy of the ey-Laws is attached hereto as Exhibit "E" and incorporated t~rein by reference. 2.5 Common Elements means the portions of the condominium property (including the tangible personal property required for the maintenance and operation of the condominium property) not: included in the units; and t:he unit owners' easement in and to the Common Property, granted in Section IV of the Declaration of Covenants and Restrictions for Tarpon Bay Yacht: Club as recorded in Official Records Book 327, page 924, public records of St. Lucie County, Florida. 2.6 Common Expenses means all expenses and assess- ments properly incurred by the Association for t:he Condominium and includes, but is not-_ limited to: the expenses of administration and maintenance, operation, repair and replacement of the common elements and of the portions of units to be maintained by the Association; taxes, special assessments and insurance for the common elements; other expenses declared to be common elements herein and in the By-Laws; and any ot-_her valid charge against: the Condominium as a whole. 2.7 Common Property means the real property in St. Lucie County, Florida more particularly described in Exhibit "A" to the Declaration of Covenants and Restrictions for Tarpon Bay Yachr. Club, as recorded at Official Record Book 327, Page 924, Public Records of St. Lucie County, Florida. 2.8 Common Surplus means the excess of all receipts of the Association, including but not limited r_o, assessments, i rents, profits and revenues on account of the common elements, over the amount of common expenses. i 2.9 Condominium means all of the condominium property as a whole when t:he context so permits, as well as that form of ownership of real property which is comprised of units that may be owned by one or more persons, and in which there ` is appurtenant to each unit an undivided share in the common elements. 2.10 Condominium Act means Chapter 718, Florida Statutes, in existence as of the date of this Declaration. 2.11 Condominium Parcel means a unit, together with ~ the undivided share in the common elements which is appurtenant to t the unit. 2.12 Condominium Property .means and includes t:he lands, leaseholds, and personal property-that are subject t:o condominium ownership, whether or not: contiguous, all improvements thereon, and all easements and rights appurtenant r_hereto intended for use in connection with. the Condominium. 2.13 Declaration or Declaration of Condominium means this instrument as it may from time t:o time be amended. 2.14 Developer means S.C.S. TARPON BAY, INC. and ~ HASCO TARPON BAY, INC., both Florida corporations, a joint: venture D/B/A TARPON BAY, its successors and assigns, and whoever offers for sale condominium .parcels created herein in t:he ordinary course- .
