HomeMy WebLinkAbout0484 of business; except the term shall not include the owners of units who have not acquired all the right, title and interest of TARPON BAY in the condominium property. 2.15 Institutional Mort a ee means a bank, bank holding company, or subsidiary thereo savings and loan associa- tion, insurance company, union pension fund, mortgage company approved by Developer, its successor, grantees or assigns, agency of the United States Government, or Developer, its grantees, successors and assigns holding a first mortgage of public record on a condominium parcel or on any portion of the condominium property. ~ 4 2.16 Land means the real property in St. Lucie County, Florida, wl~ ci h is being submitted to condominium ownership and is more particularly described in Exhibit "A" attached hereto. 2.17 Limited Common Elements means those common elements which are reserved for the use of a certain unit to the exclusion of other units, and for all purposes herein shall be treated as common elements as to the unit for which they are reserved. 2.18 Occupant means the person or persons, other than the unit owner, in possession of a unit or limited common elements. 2.19 Property Owners Associaton means TARPON BAY YACf1T CLUB PROPERTY OWNERS ASSOCIATION, _ItdC. , a Florida corporation not for profit, of which all owners of dwelling units in Tarpon Bay Yacht Club shall be members. 2.20 Special Assessment means a share of the funds required for payment of common expenses which are unbudgeted or for which insufficient provision is made in the budget, occasioned by unforeseeable and fortuitous events, which from time to time may be assessed against the unit owners. 2.21 Tarpon Bay Yacht Club means approximately i twenty-one (21) acres, more or less, controlled by Developer in ~ the City of Port St. Lucie, Florida, of which the Condominium is a ~ part. "The balance of Tarpon Bay Yacht Club" means Tarpon Bay Yacht Club less the Condominium property. Developer, and others, in their sole discretion, may improve the balance of Tarpon Bay Yacht Club with other Condominiums, rental apartments, buildings, yacht basins, and improvements of every sort. Developer and others, in their sole discretion, may dredge lagoons, alter the configuration of the balance of Tarpon Bay Yacht Club, and may construct, demolish, reconstruct, and repair every sort of improvements upon the balance of Tarpon Bay Yacht Club. 2.22 Unit or Residential Unit means a part of the ` condominium property which is subject to private ownership, to be used as a single family residence and as designated on the exhibits attached to this Declaration. 2.23 Unit Owner means the owner of a condominium _ parcel. 2.24 Singular, Plural, Gender. Whenever the context s so permits, the use of the singular shall include the plural and the plural shall include the singular, and the use of any gender ' shall be deemed to include all genders.
