THIS CAUSE having come on to be heard upon the Defendant's,

z conference and order setting trial and having heard arguments

of the parties and being fully advised in these premises, the

> undersigned finds that:
~ 1. Pursuant to the Stipulation entered into between all j

~'j ~ parties of this action dated October 24, 1979, the Plaintiff was
` to furnish written Notice to the Defendant, FORT PIERCE ASSOCIATES,

~ o of its completion of discovery and upon this written Notice the j
Defendant, FORT PIERCE ASSOCIATES, would have thirty (30) days in

~ which to file responsive pleadings.
2. That-the Plaintiff has failed to give written Notice
pursuant to the Stipulation and because of this the Defendant,
FORT PIERCE ASSOCIATES, has not been required to file any
responsive pleadings.

WHEREFORE, the undersigned hereby sets aside its previous
Order setting this cause for pre-trial conference and for Trial,
December 8th and 9th, respectively, and removes this cause from j
the Trial Docket. This order shall also constitute written Notice
