ORDER ON PRE-TRIAL CONFERENCE
A Pre-Trial Conference having been scheduled and the parties
having met prior to the Pre-Trial Conference and reached an agreement,
it is
ORDERED AND ADJUDGED:
1. STIPULATIONS AND ADMISSIONS were made as follows:
(a) On or about May, 1979, the Plaintiff purchased a
home and real property in St. Lucie County, Florida, from GENERAL
DEVELOPMENT CORPORATION.
(b) At that time and place the Defendant, GDV FINANCIAL
CORPORATION, provided financing for said purchase and received a
mortgage on the subject property which required, among other things,
fi that the premises be properly insured.
(c) That at the time and place of the closing the
Defendants, or one of them, arranged and secured insurance coverage
for the subject premises, conveyed the premium paid by the Plaintiff -~'f

therefor to the insurance company. ~
(d) The insurance company holding the insurance policy

of the premises denied coverage based upon the terms of the insurance
~ policy which excluded, among other things, damage to screen enclosures I
of outdoor swimming pools by windstorms.
' (e) The swimming pool and screen enclosure were a part
of the original purchase of the real property from GENERAL DEVELOPMENT
~ CORPORATION.
(f) That the screen enclosure was constructed by, or
