C., a corporation organized, chaztered and existing pursuant to the laws of the United States of America, hereinafter called second party, WITNESSETH, that, WHEREAS, first party is indebted to second party in the principal sum of--One Hundred Thirty five Thousand and No/100-----------------Dollars (=135,000.00----~, as evidenced by a certain promissory note, of even date herewith, payable to the order of second party in Twenty (20) I~ successive Annual installments of principal, the first installment of principal being .I due and payable on the 1st day of July , 19 82, with 'I interest from date of said note payable as and at the rate(s) provided in said note, al! of which and such other terms, conditions, and agreements as are contained in said note will more fully appeaz by reference thereto, which note is made a put of this mortgage to the same extent as if it were set out in extenso I herein. This mortgage secures (1) the promissory note above recited; (2) all futwe advances as hereinafter provided for, that subsequently may be made to fast poly (or to 'any one or more of the polies designated herein as fast party with the ~ written consent of the remainder of said parties) by second puty; (3) all other indebtedness of lust poly, (or one or more of them), to second party now due or to become due under the terms of this instrument, the above recited note, any future I advance note, or other evidence of indebtedness secured hereby and all renewals, reamortiutions,exrension:, deferments or other rearrangements of any indebtedneu secured hereby, together with interest thereon as provided for. 'j NOW, KNOW ALL MEN, that first party, in consideration of the debt as evidenced by above described note, and for ! better securing the payment thereof to second poly, according to the terms of said note, and the performance of the conditions and covenants herein contained and to secure any other indebtedness of fast poly to second party as contempLted under the terms hereof and also in consideration of the sum of One Dollar to fast poly in hand paid by second poly, receipt whereof is hereby acknowledged, has granted, bugained, sold and released, in fee simple, and by these presents does grant, bugain, sell and release, in fee simple, unto second party, its successor and assigns, the following described lands, f including but not limited to, all trees, timber, shrubbery, fixtures and improvements now and hereafter thereon: { ~ The South of the Northwest : of Section 9, Township 37 South, Range 38 East, St. Lucie County, Florida; LESS any part thereof lying South or East of a center line of a now existing road said center line being described as follows: begin at a point 58 feet East and 93 feet Sout .i of the Northwest corner of the Northeast ; of Section 17, Township 37 South, Range 38 East from said point of beginning, thence run Easterly 2,586.9 feet to a point 29.5 fee South of the Northeast corner of the Northeast ~ of said Section 17, thence continue Easterly 2,651.05 feet to a point 39 feet West and 36.5 feet North of the Southeast h corner of the Southwest 4 of Section 9, Township 37 South, Range 38 East, thence turn ~i and run Northerly 5,302.85 feet to the Northeast corner of the Northwest ~ of said Section 9, said corner being in the center of said road; ~ AND SUBJECT TO a road easement over and upon any property lying within 30 feet of said center line above described, said easement, being set forth in paragraph 1 (a) of an easement for roads and canals given by Wright W. Carlton and Annie G. Carlton, his wife to Edsall Groves, Inc., and Herschel A. Auxier, dated June 2, 1961, recorded in t Official Records Book 11, Page 321, and to W ~ W Groves Company, Inc. and others dated June 2~, 1961, recorded in Official Records Book 12, Page 534, and in similar instru- ments now appearing of record, all in the Public Records of St. Lucie County, Florida. • i Said lands containing 81.3 acres more or less, lying and being in St, Lucie County, Florida.
