THIS DECLARATION OF CONDOMINIUM made this t2 Today of
No~Q,nntiJ ~L ,1980 , by ISLAND PARTNERS , INC . , a Florida corpor-
ation, called Developer, for itself, its successors, grantees.
and assigns.
WHEREIN the Developer makes the following declarations:
1. PURPOSE. The purpose of this Declaration is to submit
the lands escr ed in this instrument and improvements on those
lands to the Condominium form of ownership and use in the manner
provided by Chapter 718, Florida Statutes, hereafter called
The Condominium Act.
1.1. NAME ADD ADDRESS. The name by which this Condominium
is to be ident ie $ D BEACH CLUB, a Condominium, 9800
South A-1-A, Jensen Beach. Florida, 33457, hereafter called the
"Condominium".
2. DEFINITIONS. The terms used in this Declaration and
in its exhibits s
aIT have the meanings stated in The Condominium
Act (Section 7:8.103, Florida Statutes) and as follows unless the
context otherwise requires:
2.1. APARTMENT means unit as defined by The Condominium Act.
2.2. APARTMENT OWNER means unit owner as defined by The
Condominium Act.
2.3. ASSOCIATION means HUTCHINSON ISLAND BEACH CLUB,
INC., anon-pro~Iorida corporation, and its successors.
2.4. BY-LA'wS means By-laws of the Association and of the
Condominium.
2.5. COMMON ELEMENTS shall include the tangible personal
property require or t e maintenance and operation of the
Condominium even though owned by the Association. as well as the
items stated in The Condominium Rct.
2.6. LIMITED COITION ELEMENTS means and includes those
elements whic are reserve or the use of a certain apartment or
apartments to the exclusion of other apartments.
2.7. COMMON EXPENSES include:.
a. expenses of administration; expenses of insur-
ance, maintenance. operation, repair, replacement and
betterment of the common elements aad of the portions
of units to be maintained by the Association.
