WITN ESSETH: 'T'hat Grantor, for and in consideration of the sum of TEN (10.00) DULI.ARS and other good and valuable consideration paid by Grantee, the receipt of which is hereby acknowledged, has granted, bargained, and sold to Grantee and Grantee's heirs and assigns forever, the following described real property situated, lying and being in St. Lucie County, Florida, to-wit: The Condominium Parcel known as Apartment 824_B of Phase I of HICGtI POINT OF FORT PIERCE CONDOMINIUM Sf:CTIO~ III {the "Condominium") according to the Declar- ation of Condominium thereof ("Declaratior."), recorded in Official Records Book 34f at Pages 2403 through 2542 of the Public Records of St. Lucie County, Florida as the Declaration may have been amended by any amendments - recorded in the Puhlic Records of St. Lucie County, f'lorida including, but not limited to, any amendment to add the aforesaid Phase to the Condominium (if such Ph~3se be ether than Phase I thereof). Grantee, by acceptance hereof, and by agreement' with Grantor hereby expressly assumes and agrees to be bound by and to comply with .all of the covenants, terms, conditions and provisions set forth and contained in the ` afor-edescrihed Declaration of Condominium, including, but not limited to, the obligation to make payment of assessments for the maintenance and operation of the Condominium which may be levied against the above-described Apart- ment. Grantee expressly acknowledges the existence of a Settlement Stipula- lion and Agreement for and Grant of Easements and Other Rights (the "Settle- ment Stipulation") and a Declaration of Protective Covenants and Restrictions - (the "Protective Covenants"), as cvel[ as the "Designation Notice" modifying the Settlement Stipulation and Protective Covenants, all as hereinafter set forth. The Settlement Stipulation provides for this Condominium to be served by certain facilities of Hiyh Point of Fort Pierce Condominium Section 1 and the Protective Covenants provides for certain land use covenants upon the j 1<-ind areas described therein (including, but not limited to, portions of the ~ land areas included within this Condominium) and provides for certain drainage easements <:nd other easements and rights including, but not limited to, the i "Roadway Easement", "Sewage System Rights", "Water System Rights" and "i uture Development Property Drainage Easement", all as are more particular- ly ciescribeci therein, all in addition to the other matters set forth in the Settlement Stipulation and Protective Covenants, which other maters include, but are not limited to, the obligation to pay certain "Assessments" as are respectively set forth in the Settlement Stipulation and Protective Covenants. Grantee exprealy acknowledges and assumes the obligation to pay the amounts . - assessed against the Apartment under both the Settlement Stipulation and Protective Covenants and acknowledges that "Assessments" under both the Settlement Stipulation and Protective Covenants against all properties now or hereafter included within this Condominium in accordance with the above- ~ described Ueclaration of Condominium are "Common Expenses°' of this Condomin- ium as provided for in the Declaration of Condominium.
