O'Brien, late of Ashtabula County, Ohio, died on May 12, 1973 leaving a last will and testament dated May 21, 1952 which was duly proved and admitted to probate and record in the Court of Common Pleas, Probate Division, in and for Ashtabula County, Ohio, a court of probate jurisdiction, on June 26, 1973. 2. The decedent died owning an undivided one-third interest in and to the following described real property situate in St. Lucie County, Florida: Lot 2, Block 3, ST. LUCIE GARDENS, a subdivision of Section 7, Township 37 South, Range 41 East,, as per plat of said subdivision recorded in Plat Book 1, page 35, public records of St. Lucie County, Florida; ~ said real property being the only property situate in the State of Florida in which the decedent owned an interest, having j received said interest through purchase together with Melinda ' Smyth and Elizabeth Z. Smyth from George Sawyer Lennard and Lyda T. Lennard, his wife, as shown by deed dated November 4, ~ 1957, recorded in heed Book 232, page 513, public records of ! St. Lucie~County, Florida. 3. Petitioner is attorney for Ann A. Davis as ancillary r personal representative of the Estate of Elizabeth Z.
