4. The decedent's will complies with the laws of
the State of Florida as to form and manner of execution, and
devises all the rest, residue and remainder of his property
to Melinda Smith. The undivided one-third interest in the
real estate described herein constitutes a portion of the
decedent's residuary estate.
5. Duly authenticated copies of the Application for
Probate of Will; the Will; Proof of Signature of Witness to
Will; Application of Commission to take Deposition of Witness
to Will and Order for Commission; Notice to Next of Kin;
Cot~unission; Testimony of Witnesses; Judgment Entry; Applica-
tion for Appointment, Journal Entry and Letters of Executrix;
Proof of Publication; Estate Tax Preliminary Notice; Ohio
Estate Tax Return; Notice of Filing Tax Return; Statement in
Lieu of Inventory and Appraisement; Judgment Entry; Executrix
Account; Order on Approval and Settlement; Adjustment and
Hearing Notice; Certificate of Determination of Tax; Ohio
Estate Tax Charges; and State of Ohio Receipt for taxes are
filed with this petition.
` 6. It is not necessary that an ancillary personal
representative be appointed in St. Lucie County, Florida,
~ as the decedent has been deceased for more than three years.
