DECLARATION OF PARTY FACILITIES
THIS DECLARATION OF PARTY FACILITIES, by and between
HARRIS CONSTRUCTION CORPORATION, a Florida corporation, herein-
after referred to as "Owner", and The Public, is to evidence the
following:
WITNESSETH:
WHEREAS, Owner owns in fee simple the following described .
real property, situate, lying and being in St. Lucie County,
Florida, to-wit:
Lots 13 and 14, Block 1, of PROSPERITY PARK,
as per plat thereof recorded in Plat Book 7,
page 55, of the public records of St. Lucie
County, Florida
and
WHEREAS, Owner has constructed upon the aforesaid Tract
two duplex structures, each composed of two single-family dwellings
connected by a common wall; and
WHEREAS, each such single-family dwelling is designed
to be owned and occupied solely by a single family living

independently of all others; and

WHEREAS, each such single-family dwelling will share a
~ common wall with the adjacent dwelling; and
WHEREAS, each such common wall is located on a line

determined by survey, dividing the aforesaid real property
into four (4) separate, distinct and approximately equal
parcels, said lines being more particularly described as the
lines separating the parcels hereinafter described in Schedule A
attached hereto and by this reference made a part hereof; and
~ WHEREAS, Owner is desirous of declaring each of said common
walls to be party walls, and is further desirous of setting
forth the respective rights and duties of the successors in title ~
to Owner of the single-family dwellings sharing said party walls,
as well as their heirs, successors, assigns and grantees;
