in the premises, it is thereupon
ORDERED AND ADJUDGED as follows:
1. Plaintiff's Motion to Dismiss Counter-Claim is denied.
The only issues in said Counter-Claim are those specifically
enumerated therein and raised by those documents attached to the
Counter-Claim and identified as Exhibits A and B. Counter-Defendant
shall have fifteen (15) days from the date of this Order in which to
file a reply to the Counter-Claim.
2. The Motions to Dismiss filed by the Additional Party
Defendants HOME SAVINGS & LOAN and JENSEN BEACH BANK be and the same
are hereby denied and the said Defendants shall have fifteen (15)
days from the date of this Order in which to answer Counter-Plaintiff's
Additional Party Complaint.
3. The Counter-Plaintiff's~Motion to file an Amendment to
its Counter-Claim and Additional Party Complaint is granted and
answers to Counter-Plaintiff's Counter-Claim and Additional Party
Complaint as required by this Order shall include an answer to
Paragraph 14 of the Counter-Plaintiff's Additional Party Complaint

as amended.
4. Plaintiff's Motion for an order imposing sanctions is
denied. However, Defendant shall furnish to Plaintiff's counsel by

December 1, 1980, a preliminary accounting which Defendant's CPA
has advised the Court is possible once he is furnished with~warious
records and information previously requested from HOME SAVINGS & ~
LOAN ASSN. In order that said preliminary accounting may be
accomplished by December 1, 1980, HOME SAVINGS & LOAN ASSN. is
ordered to forthwith furnish to Counter-Plaintiff's CPA or his
representative, such records and information as is necessary to
F complete such preliminary accounting. To accomplish such accounting,
E Counter-Plaintiffs Motion to inspect said records is granted.
