TARPON BAY, INC., a Florida corporation, hereinafter referred to as "Mortgagor", by Mortgage Deed dated the 28th day of September, 1979, and recorded in Official Record Book 317, Page 2403, public records of St. Lucie County, Florida, mortgaged unto FIRST NATIONAL BANK IN PALM BEACH, a National Banking Corporation, its successors and assigns, hereinafter referred to as "Mortgagee', the premises therein particularly described, to secure the payment of the ' sum of Seven Hundred Eighty Thousand Dollars ($780,000.00) with interest as therein mentioned, as further secured by that certain Financing Statement recorded in Official Record Book 317, Page 2415, public records of St. Lucie County, Florida: AND WHEREAS, Mortgagor has requested Mortgagee to release the premises hereinafter described, being part of the encumbered property, from the lien and operation of the Mortgage and the Financing Statement: NOW THEREFORE; Mortgagee, in consideration of the sum of SEVENTEEN THOU- SILND FIVE HLINDRED EIGHTY Dollars t7 _580_00 ) paid to it by Mortgagor, does remise, release, quitclaim, exonerate and discharge from the lien and operation of the Mortgage and the Financing Statement unto Mortgagor, all that piece, parcel or tract of land, being a part of the encumbered property, to-wit: UNIT lpl of TARPON BAY YACHT CLUB CONDOMINIUM according to the DECLARATION OF CONDOMINIUM dated October 20, 1980 and recorded in Official Rec- . ord Book 343 Page 482 Public Records of St. Lucie County, Florida; together with the undivided share of the COMMON ELEMENTS of the Condominium declared in the Declaration to be appurtenant thereto; together with all appurtenances thereto, including, without limi- tation, the right of exclusive use of those areas, spaces and portions of COMMON ELEMENTS of the Condominium, dec- lared in the Declaration of Condominium to be LIMITED COMMON ELEMENTS of the Unit. , TO HAVE AND TO HOLD the same, with the appurtenances, unto Mortgagor, its heirs and assigns forever, freed, exonerated and discharged of and from the lien of the Mortgage and the Financing Statement, and every ~ part thereof; Provided, however, that nothing herein contained shall in anyway impair,. alter or diminish the-effect, lien or incumbrance of Ij the aforesaid Mortgage and the Financing Statement of the remaining part of the property not hereby released therefrom, or any of the rights and remedies of Mortgagee. . _ ~~Bp IN WITNESS WHEREOF, Mort a ee has caused these g g presen~~ be • eie~'~iited in its name and its corporate seal to be affixed, by~~~C~~r ct~~,i.cers, ~ this 18th day of Noveaber 1980 y ro 7~.
