ORDER
THIS CAUSE came on for hearing on the Motion to Dismiss
and Motion to Consolidate filed on behalf of the Defendants,
PETER P. NAIMO and CARMEL E. NAIMO, his wife and the Court
having heard the argument of the respective counsel and .
having considered the record in this cause, finds:
1. That the Defendants' Motion to Dismiss is hereby
denied. Defendants shall have twenty (20) days in which to
respond to the Complaint in this cause.
2. The Motion to Consolidate this cause with that
action styed Peter P. Naimo and Carmel E. Naimo, his wife,
Plaintiffs, vs. Pointe South Builders,Inc., a Florida
Corporation, Richard Miller, a/k/a/ Richard R. Miller and Nora
Miller, Defendants, is granted. All pleadings shall be filed
in Case No. 80-429-CA.
