ORDER
This cause came on to be heard upon Plaintiff's Motion to File
an Amendment to the Complaint and upon Defendant's Renewed Motion to
Stay.
Defendant's pleadings reveal, and the Court finds, that the
Defendant did not act timely and in good faith in invoking the
"APPRAISAL" provision of the subject policy of insurance. See
18A Fla. Jur. 158, et seq,~INSURANCE $884 and cases cited therein.
Having considered the court file, having considered argument of counsel
and being otherwise advised in the premises, it is thereupon,
ORDERED AND ADJUDGED as follows:
1. Plaintiff's Motion to File an Amendment to the Complaint
is granted and Defendant shall have fifteen (15) days from the date of
this Order in which to file an answer to said Amendment.
2. Defendant's Renewed Motion to Stay is denied.
