FINAL JUDGMENT
This matter having come before the Court on the trial of the issue
of negligence and damages, and pursuant to a verdict rendered in this
action on the 25th day of November, 1980, wherein a duly impaneled jury
entered a verdict signed by the Foreperson, HARVEY L. THOMAS, in assess-
ing the total damages of the Plaintiff, ALFRED CHRISTOPHER WAGONBLAST,
in the amount of SEVEN THOUSAND AND NO/100 DOLLARS ($7,000.00), against
the Defendants, RUTH R. MITCHELL, d/b/a JOE'S 66 SERVICE STATION, and
AMERICAN HOME ASSURANCE COMPANY, and the verdict further assessing that
said Defendants were seventy per cent (70$) negligent and said Plaintiff
was thirty per cent (30$) negligent, that Plaintiff, ALFRED CHRISTOPHER
WAGONBLAST, recover from Defendants, RUTH R. MITCHELL, d/b/a JOE'S 66
SERVICE STATION and AMERICAN HOME ASSURANCE COMPANY, the sum of FOUR
THOUSAND NINE HUNDRED AND NO/100 DOLLARS ($4,900.00), it is
ORDERED that the Plaintiff, ALFRED CHRISTOPHER WAGONBLAST, recover
from the Defendants, RUTH R. MITCHELL, d/b/a JOE'S 66 SERVICE, and
AMERICAN HOME ASSURANCE COMPANY, the sum of FOUR THOUSAND AND NINE HUNDRED
AND NO/100 DOLLARS (54,900.00) for which sum let execution issue.
IT IS FURTHER
ORDERED AND ADJUDGED that the Court reserve jurisdiction for entrance
of cost judgment to be heard upon proper notice and filing of the Motion.
