MODIFICATION AGREEMENT
THIS INDENTURE, made this ~ day of t~~~~V ,
19~~, between THOMAS F. COOK and SHIRLEY COOK, of Manatee County
Florida, hereinafter referred to as "Mortgagees ", and ROBERT L.
BANKER and JENNIFER L. BANKER, his wife, of St. Lucie County,
Florida, hereinafter referred to as "Mortgagors ",
WITNESSETH:
WHEREAS, Mortgagors executed and delivered to Mortgagees a
certain purchase money mortgage dated July 20, 1979 and recorded
in Official Records Book 313, Page 1320 of the Public Records of
St. Lucie County, Florida, securing a promissory note therein
described in the original principal sum of $22,000.00, on which
is now owing the principal sum of $19,976.52, and
WHEREAS, Mortgagors and Mortgagees have agreed to modify the
terms of said promissory note and mortgage,
NOW, THEREFORE, in consideration of the premises and the sum
of $10.00, each to the other in hand paid, receipt of which is
hereby acknowledged, it is hereby agreed as follows:
1. Mortgagees acknowledge receipt, on the date above
written, of the payment of $3,000.00, to be applied toward the
reduction of principal, reducing the principal amount due to
$16,976.52.
2. The interest rate shall be increased from 8 per cent
per anntan to 10 per cent per annum.
3. In all other respects, the promissory note and mortgage
shall remain unaffected, unchanged and unimpaired by reason of
the foregoing modification.
