WELL AND WATER LINE EASEMENT

p y part, and DANIEL C. SCOTT,
JR. and EDGAR A. BROWN, Co-Personal Representatives of the Estate of '
DANIEL C. SCOTT, SR., party of the second part,
WITNESSETH, that for and in consideration of the sum of $1.00
cash in hand paid, the receipt of which is hereby acknowledged, the
party of the first part has this day bargained and sold, and by these
presents do bargain, sell, convey, transfer and deliver unto DANIEL C.
SCOTT and EDGAR A. BROWN, Co-Personal Representatives of the Estate
of DANIEL C. SCOTT, SR., a permanent easement and right of way,
including the perpetual right to enter upon the real estate herein-
after described, at any time that they may see fit, to construct,
maintain and repair a fresh water well and underground pipeline for
the purpose of conveying fresh water over, across, through and under
the lands hereinafter described, together with the right to excavate
and refill ditches and/or trenches for the location of said pipeline,
and the further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and maintenance
of said pipeline which shall be at a minimum depth of two (2) feet below
the surface of the surrounding ground. This easement is not exclusive.
Upon the Grantee, his successors or assigns, obtaining a
satisfGctory site for afresh water well other than within this
easement or upon a public utility providing fresh water through a
utility main servicing the Grantee's property, this easement shall
revert to the Grantor, his successors and assigns and shall terminate.
The land affected by the grant of this easement and right of way
is located in the County of St. Lucie and State of Florida, and is
more particularly described as follows:
The easterly five feet and the southerly five feet ;
of the following described lands:
Begin at the South 1/4 corner of Section 28, To~,m-
ship 34 South, Range 40 East, run thence North
along the 1/4 Section line 363.9 feet to a point;
thence run East 120.4 feet for Point of Beginning;
from the Point of Beginning, run northwesterly along
the East right-of-way line of State Road No. 4,
126.9 feet; thence North 80° 41' East, 539.3 feet;
~ thence South 208.3 feet; thence West 484.0 feet to
the Point of Beginning.
LESS AND EXCEPTING THEREFROM right of way for Public
