Once this 1liortgage I~as been accelerated by virtue of this acceleration clause, subsequent payment of arrears shall not cure tt~e default unless expressly agreed to in writing by the Mortgagee. 6. Time is of the essence of this rnntract, but a waiver by the Aortgagee of a breach of any of the terms or rnnditions of said Note, or of this Mortgage. on any one occasion shall not constitute a waiver of a subsequent breach of any of the terms or conditions of either said Note or this Mortgage on any other occasion. y. If foreclosure proceedings of any first or sernnd mortgage or any junior or senior lien or encumbrance shall be instituted, the Mortgagee may immediately declare its debt hereby secured. and the Note evidencing same. as being immediately due and payable, and may start such proceedings as may be necessary or advisable to protect its interest in the premises, including the appointment of a receiver, and its lien herein granted upon rents, issues and profits shall be prior to the lien of any junior encumbrancer or lien holder upon the rents, issues or profits rnllected or to be collected by a receiver appointed at the instance of any junior encumbrancer or lien holder. 8. This lLiortgage shall secure any and all renewals or extensions of the loan secured hereby in whole or in part, and no renewals or extensions shall be deemed a payment so as to discharge this 1lfortgage. The lien of this 1liortgage shall extent to and include any expenses that might be incurred by the Mort- gagee in the enforcement and collection of said Note, taking possession of the property for the purpose of preserving, maintaining or letting the same after default of the Mortgage and abandonment of the property by the Mortgagors, and rnllecting all indebtedness of the I1lortgagors to the :lortgagee hereinabove recited, and should legal or equitable proceedings be instituted for the collection of said I~Tote or said indebtedness, or any part thereof, the Mortgagors shall be liable for and pay all reasonable attorneys' fees and expenses incurred by the Mortgagee or its assigns to the fullest extent permitted by applicable law. 10. The lien of this ~3ortgage shall extend to and cover all property and property rights, real and personal, and of whatever character or nature. that may at any time hereaker be acquired, owned, held, possessed, or enjoyed in any manner by.t~e Mortgagors in or on the Property. 11. The covenants rnntained herein shall inure to the benefit of, and be binding upon, the respective heirs, personal representatives, successors and assigns of the Mortgagors and the :Mortgagee. NOW, should the Mortgagors well and truly pay said debt and interest, and perform all of the covenants and agreements herein set out, and in the Note secured hereby, then the Mortgagee will release this Mortgage at the request and cost of the Mortgagors.
