HomeMy WebLinkAbout1695THE GRANTEE, Ru-Mar, Inc., a Florida corporation, its successors and assigns, is hereby granted a perpetual easement for drainage and irrigation purposes, on and in the canal located on the property described above. Ru-Mar, Inc., its successors and/or assigns, will have the right to install culverts draining into the canal and•open ditches draining into the canal and will also have the right to drain Sections 19, 29, 30, 31 and 32, Township 37 South, Range 38 East, into said canal, including, but not limited to, that portion of the property belonging to Ru-Mar, Inc. lying South and East of the Florida East Coast Railway right-of-way. Ru-Mar, Inc., its successors and assigns, also shall have the perpetual right to withdraw water from the canal for irrigation pur- poses and will have the right to install stop logs subject to the approval of the County Commission during dry periods to hold the water in the canal. The County can place additional material removed from the canal on the spoil bank which is com- pleted and is part of said canal. Ru-Mar, Inc. its successors and assigns, will own all material removed from the canal, both in the original construction and in any future maintenance and will be allowed to remove said material at any time. THE PERPETUAL EASEMENT reserved in the Grantor, St. Lucie County, to operate and maintain said canal, will not be open to the general public and only County officials or County employees on official business, will be authorized to go onto said easement and Ru-Mar, Inc., the Grantee, or its successors or assigns, will have the right to keep gates locked, other than when necessary for the maintenance or inspection of the canal and the agents or employees of Ru-Mar, Inc., or its successors or assigns, will also have the right to go onto and enter said easement area at any time. Ru-Mar, Inc., its successors or assigns, will furnish keys for the locked gates installed by Ru-Mar, Inc. at the easement area and whenever possible, the Grantor, St. Lucie County, its agents or employees, will notify the Grantee, Ru-Mar, Inc., when County employees will be entering the easement area. THE GRANTEE, Ru-Mar, Inc., or its successors or assigns, shall have the permanent or perpetual right to cross the canal at the areas where the railroad crossings are permitted or are located or are authorized i 2 ~ ~~~~344 P~if~~ ~~ ~_- _ = y
