MORTGAGE DEED
THIS MORTGAGE DEED, effective the 23rd day of April, 1980,
by I. PAUL CHUDNOW and PHYLLIS G. CHUDNOW, hereinafter called
Mortgagors, to LAWRENCE WEINER PROFESSIONAL ASSOCIATION,
Trustee (a Florida professional service corporation),
hereinafter called Mortgagee.
WITNESSETH, that for divers good and valuable
considerations, and also in consideration of the aggregate sum
named in the promissory note of even date herewith, hereinafter
described, the said Mortgagors grant, bargain, sell, alien,
remise, release, convey and confirm unto the said Mortgagee,
its successors and assigns in fee simple, all that certain
tract of land, of which the said Mortgagors are now seized and
possessed, and in actual possession, situate in St. Lucie
County, State of Florida, described as follows:
Condominium Parcel 134 of CAPSTAN I,
according to the Declaration of Condominium
thereof, recorded in Official Records Book
232, pages 619 through 711, of the Public
Records of St. Lucie County, Florida
TOGETHER with all structures and improvements now and
hereafter on said land, and fixtures attached thereto, and all
rents, issues, proceeds, and profits accruing and to accrue
from .said premises, all of which are included within the
foregoing description and the habendum thereof; also all gas,
steam, electric, water, and other heating, cooking,
refrigerating, lighting, plumbing, ventilating, irrigating, and
power systems, machines, appliances, fixtures, and
appurtenances, which now are or may hereafter pertain to, or be
used with, in, or• on said premises, even though they be
detached or detachable.
TO HAVE AND TO HOLD the same together with all and singular
the tenements, hereditaments and appurtenances thereunto .
belonging or in anywise appertaining, and the reversion and
reversions, remainder or remainders, rents, issues, and profits
thereof, and also all the estate, right, title, interest,
