be and the same is hereby denied on the grounds that the
Court finds a failure to show necessity for said parcels
described above.
The petitioner, FLORIDA POWER & LIGHT COMPANY, is hereby
required to deposit in the Registry of this Court $5,300.00
which sum the Court finds will fully secure and fully
compensate the persons entitled to compensation as ultimately
determined by the Final Judgment to be entered herein. Said
sum shall be deposited in the Registry of this Court within
twenty (20) days from the date of this Order, and upon making
such deposit, the petitioner shall be entitled to enter into
possession of the parcels of property described as Parcels
lA, 1B and 1C to the extent of the interest in said property
sought to be taken by petitioner as set out in the Petition
in Eminent Domain Proceedings and described as follows:
A perpetual easement to be used for the
construction, operation, and maintenance of
one or more electric transmission and
distribution lines, with all rights necessary
and convenient for the full use thereof,
including wires, poles, "H" frame structures,
towers, guys, and necessary appurtenant
equipment, in, over, upon, and across the
lands described herein as Parcels lA, 1B and
1C, sometimes referred to as "right-of-way"
