HomeMy WebLinkAbout2252or "the right-of-way," which by reference is incorporated herein, together with the right to reconstruct, inspect, alter, improve, remove, or relocate such transmission and distribution lines on the right-of-way above described, with all rights necessary and convenient for the full enjoyment and use thereof for the above-mentioned purposes, including, without limitation, the right to construct roads and to cut and keep clear all trees and undergrowth and other obstructions, within said right-of-way that may interfere with the property construction, operation, and maintenance of said electric transmission and distribution lines. Reserving to the owners, however, the right and privilege to use the parcels of land described herein as Parcels lA, 1B and 1C for growing of crops and all other purposes, except as herein state or as might interfere with the Company's use thereof, provided that no building or structures, other than fences which. do not interfere with the Company's use of said parcels will be located or constructed by the owners on said parcels of land, and provided, further, that the owners shall not excavate any portion of the right-of-way without written vermission of the Company, which permission shall not be unreasonably withheld by Company. Reserving, further, to the owners the right to construct roads, canals, culverts or underground utility facilities at their own cost and expense across the parcels of land described herein as Parcels lA, 1B and 1C, except such road, canal, culvert, or underground utility facilities as may interfere with the structures or facilities or access to same, constructed or installed by the Company; provided, further, that no such construction of roads, .canals, culverts, or underground facilities shall be made without providing written notification to the Company in advance of such construction. The foregoing interests shall thereupon be vested in petitioner, but in default of making such deposit within the time specified, this Order shall be void and of no further force and effect.
