ORDER TAXING COSTS, INCLUDING
ATTORNEYS' FEES
This cause came on for hearing upon the Motion to Tax
Costs including Attorneys' Fees, filed herein by the Defendants,
FLORIDA EAST COAST RAILWAY COMPANY, Attorneys for all parties appearing,
and the Court having heard and considered evidence offered by the
parties hereto, and having heard argument of counsel for the respective
parties, it is, upon consideration,
ORDERED AND ADJUDGED as follows:
1. That the Plaintiff pay the sum of $ 5,500.00
to Ben L. Bryan, Jr., Trust Account, for the payment of the following
costs herein:
(a) David P. Bishop, Appraiser $ 2,500.00
(b) John S. Tierney, Jr., Appraiser $ 3,0 00.0-0
2. That the Plaintiff pay to Ben L. Bryan, Jr., Esq., and
E.D. Cossaboom, Jr., Esq., as attorneys for FLORIDA EAST COAST RAILWAY
COMPANY, the sum of $ 15,000.00 as attorneys' fees herein, said
amount being hereby determined and fixed as a reasonable attorneys'
fee for services rendered to said Defendants in this cause and
$ (none) -for costs advanced.
3. That the Plaintiff shall forthwith deposit into the
Registry of this Court the sum of $20,500.00 in payment
of the amounts set forth in paragraphs one (1) and two ( 2 ) of this
Order .
