JOINT-STIPULATION TO VOLUNTARY
DISMISSAL WITH PREJUDICE
Comes now the parties, by and through their undersigned attorneys
and hereby stipulate and agree to the dismissal, with prejudice, of the
Complaint filed herein by the Plaintiff, FIRST NATIONAL BANK OF FORT
PIERCE, as Administrator of the Estate of PERRY CARLTON, deceased, and
of the Amended Counterclaim filed herein by the Defendant, CARL CARLTON, SR.,
under and in accordance with Rule 1.420, Florida Rules of Civil Procedure,
in full and complete resolution of all issues raised in and by said
Complaint and said Amended Counterclaim, either specifically or which
could be raised by the facts and other matters alleged therein the intent
hereof being to fully and finally resolve all matters which could be raised
by the FIRST NATIONAL BANK OF FORT PIERCE, Administrator of the Estate of
PERRY CARLTON and CARL CARLTON, SR., pertaining to the use and occupation
of "ALLAPATTAH" by the said CARL CARLTON, SR., each party to bear their
own attorney's fees and costs.
