ACCOUNTING AND MOTION
. TO STRIKE PETITION
THIS CAUSE coming on to be heard before me the undersigned
Judge of the above entitled Court on Petition To Lisburse Interest filed by the
Receiver, W. R. Scott, and on Motion To Strike the Receivers Petition filed
by Home Savings & Loan Association Of Florida. The Receiver of this Court,
on November ?6, 1980. filed a Petition setting forth that Home Savings & Loan
Association Of Florida has maintained in that institution accounts of Turtle
Reef Associates, Inc. and American Resorts Management, Inc. , the Petition
further alleged that $105, 293, 93 and $?, 936.00 in those accounts ought be made
available to pay the present operating expenses of Turtle Reef Associates, Inc.
and American Resorts Management, Inc. Home Savings and Loan Association
of Florida filed its Motion contending inter alia that no party to this cause is
seeking an accounting of it and that only one party to the cause is seeking a
money judgment aga inst it. It further contended that it had insuffic ient time
to contravert the Petition filed by the Receiver. At the hearing, Home Savings
E1nd Loan Association (~' Florida offered to fully account to this Court for the
account it is holding. It appears said accounting would best serve the interest
of all parties. Upon the above, it is
ORDERED that:
1. One week from this Order, Home Savings :1nd Loan Association
Of Florida shall file its accounting with this Court and serve copies on all parties,
fully accounting for those accounts it is hold ing of Turtle Reef Associates, Inc.
and A merican Resorts Management, Inc. Said accounting shall show all deposits
and disbursements from the account.
2. Ten days after the accounting is filed, any party to this
cause who objects to any portion of the accounting shall file a formal objection
