GRANT OF
NON-EXCLUSIVE EASEMENT
THIS INDENTURE made this 12th day of December, 1980
between PEACOCK FROIT AND CATTLB CORPORATION, a Florida
corporation, hereinafter referred to as "Grantor", and S.T.
WOOTBN CONSTRUCTION COMPANY, INC., a corporation organized
and existing under the laws of the State of North Carolina,
hereinafter referred to as "Grantee".
WITNESSETH AS FOLLOWS:
THAT for and in consideration of the sum of TEN DOLLARS
($10.00) and other good and valuable considerations to it in
hand severally paid by the said Grantee, the receipt whereof
is hereby acknowledged, the Grantor does hereby grant unto
the Grantee, its officers, directors, agents, and/or employees,
a non-exclusive easement for ingress and egress over and
across the property in St. Lucie County, State of Florida,
more particularly described in Exhibit A, attached hereto
and made a part hereof.
There is reserved to the Grantor, its successors and
assigns, the right and privilege to use the above described
land at any time, and in any manner, and for any purpose,
not inconsistent with the full use and enjoyment by the
Grantee, its officers, directors, agents and/or employees,
of the rights and privileges herein granted.
IT IS FURTHER UNDERSTOOD that Grantor, its successors
or assigns, shall have the right, but not the duty, to
construct, improve, repair, or maintain any roadway on the
above described land.
IT IS FURTHER ONDERSTOOD that Grantor, its successors
and assigns, assumes no liability or responsibility to or
for Grantee, its officers, directors, agents, and/or employees,
