A. Appointment of Trustee: I appoint the SUN
BANK OF ST. LUCIE COUNTY, and the successors to its business
by merger or otherwise, as Trustee.
B. Powers of the Trustee: The Trustee shall
have the powers and duties of custodians under the Florida
Gifts to Minors Act, together with all other powers and
protection granted to trustees by statute at the time of
application, including, but not limited to, the prudent
man rule and the Uniform Principal and Income law. I waive
compliance by the Trustee with the provisions of the Trust
Accounting Law as it now exists or may hereafter be amended.
I further waive compliance with any other law requiring
qualification of trustees or administration or accounting
by trustees under the supervision of any court. Should the
Trustee elect or be required to establish their qualifica-
tions before any court I waive notice to all of the bene-
ficiaries of the proceedings. I direct that the Trustee
shall serve without bond and receive reasonable compensation
for its services .
C. Duties of the Trustee: The Trustee shall hold
the gift for each person in a separate trust. The Trustee
shall manage the trust fund and apply so much of the net
income and the principal as in its judgment and discretion
shall be necessary or desirable for the education and maintenance
in health and reasonable comfort of the beneficiary. The
judgment and discretion of the Trustee shall be exercised
only after consideration of all other income and cash re-
sources available to the beneficiary without borrowing or
sale, for such purposes as are known to the Trustee. An
invasion of the principal may be made, even though it.re-
sults in a termination of the trust, provided it is necessary
for the maintenance or education of the beneficiary. Un-
