PARTIAL RELEASE OF MORTGAGL•: AND FINANCING STATEMENT ~ ~

WHEREAS, S.C.S. TARPON BAY, INC., a Florida corporation, hereinafter
referred to as "Mortgagor", by Mortgage Deed dated the 28th day of
September, 1979, and recorded in Official Record Book 317, Page 2403,
public records of St. Lucie County, Florida, mortgaged unto FIRST
NATIONAL BANK IN PALM BEACH, a National Banking Corporation, its
successors and assigns, hereinafter referred to as "Mortgagee", the
premises therein particularly described, to secure the payment of the
sum of Seven Hundred Eighty Thousand Dollars ($780,000.00) with interest
as therein mentioned, as further secured by that certain Financing
Statement recorded in Official Record Book 317, Page 2415, public
records of St. Lucie County, Florida:
AND WHEREAS, Mortgagor has requested t4ortgagee to release the premises
hereinafter described, being part of the encumbered property, from the
lien and operation of the Mortgage and the Financing Statement:
NOW THEREFORE; Mortgagee, in consideration.of the sum of Nineteen Thou-
sand Eiaht Hundred Dollars ($ 19*800.00 ) paid to it by Mortgagor,
does remise, release, quitclaim, exonerate and discharge from the lien
and operation of the Mortgage and the Financing Statement unto Mortgagor,
all that piece, parcel or tract of land, being a part of the encumbered
property, to-wit:
UNIT 20~ of TARPON BAY YACHT CLUB CONDOMINIUM
~_, according to the DECLARATION OF CONDOMINIUM dated
March 11* 1980 ; and recorded in Official Rec-
ord Book 327 , Page 950 , Public Records
of St. Lucie County, Florida; together with the undivided
share of the COMMON ELEMENTS of the Condominium declared
in the Declaration to be appurtenant thereto; together
with all appurtenances thereto, including, without limi-
tation, the right of exclusive use of those areas, spaces
and portions of COMMON ELEMENTS of the Condominium, dec-
lared in the Declaration of Condominium to be LIMITED
COMMON ELEMENTS of the Unit.
TO HAVE AND TO HOLD the same, with the appurtenances, unto Mortgagor,
its heirs and assigns forever, freed, exonerated and discharged of and
from the lien of the Mortgage and the Financing Statement, and every
part thereof; Provided, however, that nothing herein contained shall
in anyway impair, alter or diminish the effect, lien or incumbrance of
the aforesaid Mortgage and the Financing Statement of the remaining
part of the property not hereby released therefrom, or any of the
