TARPON BAY, INC., a Florida corporation, hereina~ter referred to as "Mortgagor", by Mortgage Deed dated the 28th day of September, 1979, and recorded in Official Record Book 317, Page 2403, public records of St. Lucie County, Florida, mortgaged unto FIRST NATIONAL BANK IN PALM BEACH, a National Banking Corporation, its successors and assigns, hereinafter referred to as "Mortgagee", the premises therein particularly described, to secure the payment of the sum of Seven Hundred Eighty Thousand Dollars ($780,000.00) with interest as therein mentioned, as further secured by that certain Financing Statement recorded in Official Record Book 317, Page 2415, public records of St. Lucie County, Florida: AND WHEREAS, Mortgagox has requested ldortgagee to release the premises hereinafter described, being part of the encumbered property, from the lien and operation of the Mortgage and the Financing Statement: NOW THEREFORE; Mortgagee, in consideration, of the sum of Twent~ThQusand and 00l100ths Dollars ($ 20 ~ 000 _ 00 ) paid to it by Mortgagor, does remise, release, quitclaim, exonerate and discharge from the lien and operation of the Mortgage and the Financing Statement unto Mortgagor, all that piece, parcel or tract of land, being a part of the encumbered property, to-wit: UNIT 306 of TARPON BAY YACHT CLUB CONDOMINIUM p, according to the DECLARATION OF CONDOMINIUM dated March 11. 198Q ; and recorded in Official Rec- ord Book 3~~, Page 95~ , Public Records of St. Lucie County, Florida; together with the undivided share of the CO1~fMON ELEMENTS of the Condominium declared in the Declaration to be appurtenant thereto; together with all appurtenances thereto, including, without limi- tation, the right of exclusive use of those areas, spaces and portions of COMMON ELEMENTS of the Condominium, dec- lared in the Declaration of Condominium to be LIMITED COMMON ELEMENTS of the Unit.
