HomeMy WebLinkAbout0386~ (4) 60 days, all interest in that piece of real estate owned by the defendant shall be forfeited and shall constitute an assignment of the defendant's interest to the plaintiff, who thereupon shall have the sole title to the property. (i) The defendant may additionally mortgage any real estate now mortgaged but only on a second mortgage basis and not to exceed, combined, 40% of its then market value. Fore- closure or failure to pay any payment on either mortgage for a period of 60 days shall result in a forfeiture of the defendant's interest in said real estate and shall constitute an assignment of the defendant's interest to the plaintiff, who thereupon shall have the sole title to the property. (j) The death of either party while the title to any real estate is in joint tenancy shall result in a transfer of the deceased's interest to the survivor. 3. The income from the barber shop located in Rye, New Hampshire shall belong to the defendant. 4. The stocks and mutual funds owned by the parties shall be divided by an assignment and transfer of $10,000 ir- market value on the date of transfer to the plaintiff, free and clear , of any claim of the defendant. The remaining securities are assigned to the defendant, free and clear of any claim of the plaintiff. S.
