HomeMy WebLinkAbout0450Vigil 01-2308A302 ? ~ ~10895 PARTIAL RELEASE OF MORTGAGE LIEN WHEREAS, HU`['GNINSON ISLAND LII~4ITLD, INC., a Delaware corporation authorized to transact business in the State of Flocida, hereinafter called "Mortgagor," by the following described documents grAnted and conveyed unto THE F[RST Nr1TlONAI, BAN[{ OF CHICAGO, a nutional bunking assaciation, hereinafter called "1~lortgagee" and its assigns, the premises and Qroperty therein purticulr~rly described to secure the payment of the sum of money hereinafter mentioned with in!erest thereon: \tortgage ~iven by HUTCHINSON iSLAND LIM11'E1) PARTNERSHIP, us 1lortgagor, in favor of THE F1RST N:ITION AL BANK OF CHICAGO, as hlortgagee, dated December 4, 19?8, and filed in Official Record Book ?29, at Page 991, in the Public Records of St. Lucie County, Florida, in the original arnount of Twelve Millian Dollars (S12,OO0,0OO.OU), and as modified by htodifieation of Mortgage dated June 2, 1980, and recorded in Official Records Book 332 at Page 1738 of the Public Records of St. Lucie County, Florida, wherein HUTCHINSON ISLAND Lld'~ITED, INC. assumed the indebtedness secured by said hiortgage, and increased the indebtedness to the principal sum of Thirteen Million Dollars (~13,000,000.00), together with an Assignment of Leases, ftents and Profits recorded in Official Record Book 229, at Page 1002, and UCC-1 Financing Statement recorded in Official Record Book 229, at Page 1008, ull of said documents filed in the Public Records of St. Lucie County, Florida, and in addition, a UCC-1 Financing Statement filed with the Secretary of State, State of Florida, on December ?, 1978, under File No. 966909, betwe~n-said parties; and WHEREAS, the stiid Alortgage has requested the said -~lortgagee to release the premises and other proQerty hereinafter described, being a part of said tilortgage, and encumbered premises, from the liens and operation of sriid Nlortgage and other liens; ~ NOR', THEREFORE, KNOW YE, that the said n9ortgagee, in considera- tion of the premises and the sum of Ten Dollars ($10.00) and other good and v.aluable considerations to it in hand paid by or on behalf of the said mortgagor at the time of the execution hereof, the receipt whereof is hereby ~eknowledged, does ren~~ise, release, quit-claim, exonerate, and discharge fcom the lien and operation of said 1~Iortgage and other liens referred to above unto the suid 1~lortgagor, its successors and assigns that certain portion of the premises conveyed by said 1•Iortgu~-e, and other liens referred to abave more particularly described us follows: Condominium Parcel No. 4223 , SEASCr\pE I CLUSTER - YHASE (F3), a Condominium, uccorc~:ng to the Qeclaration of Condominium reeorded September 11, 1980, in Official Records Book 338, at Page 1033, of the Public Records of St. I.ucie County, Floride, and any emendments thereto. TO HAVE AND TO HOLD the same, with the appurtenances, unto the said ;~lortgagor, its successors ~nd assigns t'orever, freed, exonerated and discharged oP and from the lien of said Mortgage and every part thereof; provided slways, nevertheless that nothing herein contained shatl in anywise impair, alter or diminish the effect, lien or encumbrance of the aforesaid Mortgage and other liens rcferred to above on the remaining property of said mortg~ged premises, not hereby released therefrom, or any of the rights and remedies of the liolder thereof.
