RECEIPT, ACKNOMLEDGMENT, ASSUMPTION AND ACCEPTANCE OF PIJ~tCliASER
Purchaser, by acceptance and execution of this Receipt, acknowledges that this
purchase of a condominium unit at OCEAN YILLAGE OF HUTCHINSON ISLAND is sub~ect
ir. every respect to the Declaration of Condominiun as to the condoaainiwn in
Which his unit is located and Exhibits attaehed thereto, including but not lim-
ited to (Whether the same are attached to the Declaration of Condominium or re-
ferred to therein)~ the By-LaWS of the Association, Articles of Incorporation,
the Rules and Regulations, copy of pro~ected operating budget, copy of sales
brochure and floor plan of apartment purchased by purchaser, and all Amendments
to the aforesaid Declaration and Exhibits and the Articles of Incorporation,
By-LaWS and Declaration of Covenants and Restrietions of the Property Owners
Association; and Purchaser further aeknoWledges receipt of and reading and
examination of said Declaration, its Exhibits, budget, sales brochure and floor
plan, and acknoF-ledges that each and every provision of the foregoing is essen-
tial, to the successful operation and management of the Condominium property
and is in the best interests and for the benefit of all the oWners therein.
Purchaser and all o~ners of parcels in the afore~escribed Condominium coven-
ant and agree to abide by each and every provision of said Declaration and
Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves
all of the terms and provisions of said Declaration of Condomini~ and Exhibits
att~ched thereto, and agrees that the assessment under the Property OWner's
Association documents referred to above and the provisions thereof are reason-
ahle, fair and equitable, and said Purehaser acknoWledges and confir~ns that the
Declaration of Covenants and Restrictions of the Property Otimer's Association
has encumbered and impressed a lien upon the Condominium parcel being conveyed
to Purchaser, as security for his obligations under said Declaration of Coven-
ants and Restrictions, and said Purchaser assumes the obligations as to the
Property Owner's Association as to his condominium parcel. Purchaser confirms
that all ~arranties, representations, and inducements, if any, are as contained
in the aforesaid Declaration of Condominiun and Exhibits attached thereto, and
the common expenses and the sums due under the Property O~,mer's Association and
other charges are estimated only. No Warranty or guaranty is made or intended
nor may one be relied upon exce~t Where the same is specifically Warranted or
guaranteed in said Declaration of Condominiun and Exhibits attached thereto.
