for the payment of common expenses, which from time to time is
assessed against the unit owners.
2.2 Association means TNE WOODLAND OWNERS ASSOCIATION,
INC., the entity responsible for the operation of this Condominium,
and possibly two additional condominiums to be constructed upon
the balance of The Woodland Condominium Apartments property, as
hereinafter defined, except to the extent limited herein. A
copy of the Articles of Incorporation of the Association is
attached hereto as Exhibit D, and incorporated by reference
herein.
2.3 Board of Directors means the representative body
responsible for the management of the Condominium and business of
the Association.
2.4 ~-Laws means the By-Laws of the Association, as
they exist from time to time. A copy of t~te By-Laws is attached
hereto as Exhibit E, and incorporated herein by reference.
2.5 Common Elements means the portions of the
condominium property (including the tanqible personal property
required for the maintenance and operation of the condominium
property) not included in the units.
2.6 Common Expenses means all expenses and assess-
ments properly incurred by the Association for the Condominium and
includes, but is not limited to: the expenses of administration
and maintenance, operation, repair and replacement of the common
elements and of the portions of units to be maintained by the
Association; taxes, special assessments and insurance for the ~
common elements; other expenses declared to be common expenses
herein and in the By-Laws; and any other valid charge against the
Condominium as a whole.
2.7 Common Surplus means the excess of all receipts
of the Association, including but not limited to, assessments,
rents, profits and revenues on account of the common elements,
over the amount of common expenses.
2.8 Condominium means all of the condominium
property as a whole when the context so permits, as well
as that form of ownership of real property which is comprised of
units that may be owned by one, or more persons, and in which there
is appurtenant to each unit an undivided share in the common
elements.
2.9 Condominium Act means Chapter 718, Florida
Statutes, in existence as of trie date of this Declaration.
2.10 Condominium Parcel means a unit, together with
the undivided share in the common elements which is appurtenant to
the unit .
2.11 Condominium PropertY means and includes the
land hereby submitted to the condlorainium form of ownership,
all improvements thereon, and the common elements; and all
easements and rights appurtenant thereto.
• 2.12 Declaration or Declaration of Condominium means
this instrument as it may from time to time ~e amended.
