HomeMy WebLinkAbout07992.13 Developer means ZEPHYR, INC., a Florida corporation, its successor and assigns, and whoever offers for sale condominium parcels created herein in the ordinary course of business; except the term shall not include the owners of units who have not acquired all the right, title and interest of ZEPHYR, INC., in the condo- minium property. 2.14 Institutional Mortgagee means a bank, bank holding company, or subsidiary thereof, savings and loan associa- tion, insurance company, union pension fund, mortgage company approved by Developer, its successor, grantees or assigns, agency of the United States Goverriment, or Developer, its grantees, successors and assigns holding a first mortgaqe of public record on a condominium parcel or on any portion of the condominium property. 2.15 Land means the real property in St. Lucie County, Florida, which is being submitted to condominium ownership and is more particularly described in Exhibi~t A, attached hereto. 2.16 Limited Common Elements means those common elements which are reserved for the use of a certain unit to the exclusion of other units, and for all purposes herein shall be treated as cmnmon elements as to the unit for which they are rese~ved. 2.17 Occupant means the person or persons, other than the unit owner, in possession of a unit or limited common elements. 2.18 ~ecial Assessment means a share of the funds required for payment of common expenses which are unbudgeted or for which insufficient provision is made in the budget, occasioned by unforeseeable and fortuitous events, which from time to time may be assessed against the unit owners. 2.19 The Woodland Condominium Apartments means approximately 4.737 acres, more or less, controlled by Developer in the City of Fort Pierce, Florida, of which the Condominium is a part. "The balance of The Woodland Condominium Apartments" means The Woodland Condominium Apartments less the condominium property: Developer and others, in their sole discretion, may construct, demolish, reconstruct, and repair every sort of improvements upon the balance of The Woodland Condominium Apartments. 2.20 Unit or Residential Unit means a part of.the condominium property which is subject to private ownership, to be used as a single family residence and as designated on the exhibits attached to this Declaration. parcel. 2.21 Unit Owner means the owner of a condominium 2.22 Singular, Plural, Gender.
