If any part of the condominium property is destroyed and then rebuilt, encroachments due to construction shall be permitted and a valid easement for said encroachments and the maintenance thereof shall exist. 11.2 Utilit~ Easements. Easements are hereby granted and reserved for the Developer, unit awners, and the Association through the condominium property as may be required for utility service in order to serve the Condominium and the balance of The Woodland Condominium Apartments adequately; provided, however, such easements through a unit shall be only according to the plans and specifications for the building, or as the building is constructed, unless approved in writing by the unit owner. 11.3 Ingress and Egress. An easement is hereby granted and reserved to Developer, its successors or assigns, for pedestrian and vehicular traffic over, through, and across such portions of the conunon elements as may from time to time be intended and designated for such uses and purposes, for the use and benefit of the unit owners, and for the use and benefit of future owners of units in other condominiums comprising The Woodlands Condominium Apartments, their families and invitees, in obtaining ingress and egress for a11 such units to public rights of way. 11.4 Construction of Improvements on Balance of The Woodland Condominium Apartments. The unit owners recognize that Developer and others may have the balance of The Woodland Condominium Apartments under development for an extended time. Incident to that development, the unit owners acknowledge that the quiet enjoyment of their units and the Condominium Property may be interfered with to some extent by construction operations on the balance of The Woodland Condominium Apartments. From time to time Developer and others may present to the unit owners and the public certain renderings, plans and models showing possible future development of The Woodland Condominium Apartments. Developer does not warrant in any way these renderings, plans or models or actually how the future improvements in The Woodland Condominium Apartments will be developed. Unit owners accept ttiat any such renderings, plans or models are primarily schematic and in no way represent a final development plan of The Woodland Condominium Apartments. As a material condition for ownership of a unit, each unit owner releases Developer from any claim that he might have against Developer for the future development of The Woodland Condominium Apartments. Each unit owner acknawledges and agrees that Developer and others will have sole right of design, construction, development, and improvement of the balance of The Woodland Condominium Apartments, exclusive of this Condominium.
