HomeMy WebLinkAbout0947 , WHEREAS, it appears to each of the parties hereto that the responsible performance of the agreements hereinafter set forth by each of them will inure to the financial benefit of the parties hereto; NOW, THEREFORE, the premises stated, and in the further consideration of the sum of Ten Dollars ($10), each to the other in hand paid, the receipt whereof is respectively acknow- ledged by the parties, IT IS MUTUALLY UNDERSTOOD AND AGREED AS FOLLOWS: 1. Unless sooner terminated as hereinafter provided, this agreement shall extend for a term of ten years beginning at 12:01 A.M. on January 2, 1981 and expiring at 12:00 Midnight on January 1, 1992. For the term of this agreement, Hall will purchase the gasoline and other petroleum products for resale at the designated filling station exclusively from Johnson and will pay therefor the current dealer tank wagon price delivered at site, which payments shall be made in cash at time of delivery, or at such other times as Johnson may designate. 2. Hall agrees to operate the service station a suffi- cient number of hours each day so as to produce a minimum sales volume of not less than 25,000 gallons each calendar month of the term or the maximum amount allowed by govern- mental regulations and restrictions, whichever be the lesser amount. 3. All of the equipment for marketing gasoline and related petroleum products, including the hoist, air compressor, underground tanks, and the like, as well as other properties that may be by him acquired from the advances hereafter men- tioned, are and will continue to be the property of Hall, and the same, together with the real property are to be kept . and maintained in first-class operating condition and appearance at all times.
