THIS CAUSE having came on to be heard on Defendant,
AMERICAN STATES INSURA~~CE COMPANY'S, Motion to Dismiss on the
8th day of December, 1980, before the Honorable Philip Nourse,
which was a continuation hearing from October 27, 1980, and
after further arguments of counsel and the Court being fully
advised in the premises, it is hereby
OROERED AND ADJUDGED as follows:
l. That the Defendant, AMERICAN STATES INSURANCE
COMPA~~Y'S, Motion to Dismiss is hereby granted.
2. That this dismissal shall be without prejudice and
the Plaintiff may refile against the Defendant, AMERICAN STATES
INSURAMCE COMPANY, in a separate proceeding.
3. That the Fif th Amended Complaint filed against
AMERICAN STATES INSURANCE COMPANY is hereby dismissed without
prejudice.
