HATFIELD. as Trustee. hereinatter referred to as "Declarant", for himself, his successors, heirs, grantees, beneficiaries and assigns, WHEREIN~ Declarant make the following declarations: 1. PURPOSE. The purpose of this Declaration is to submit the~an~s herein described and the buildings, trees_ and improvements constructed on such lands to the condominium form of ownership and use in the manner provided by Chapter 718, Florida Statutes 1976, as amended, hereafter called the Condominium Act. ~ 1.1 ~iame and Address. The name by which this condominium is to be identifie~ is ORION ISLES GROVES~ a condominium, and its business address is 1401 Brickell Avenue, Suite 900, Miami, Florida 33131. 1.2 The Land. The lands owned by Declarant which are hereby submitted to the condominium form of ownership are the following described lands lying in St. Lucie County, Florida: That certain 160 acre + tract more particularly described as follows: The I~ortheast quarter (NE 1/4) of Section 7, Township 36 South, Range 39 East, excepting therefrom all rights of way for roads and drainage canals in and for St. Lucie County, Florida. which property is hereafter called "the Land." 2. DEFIi~I~IONS. The terms used in this Declaration and in its exhibits shall have the meanings stated in the Condominium Act and as follows, unless the context otherwise requires: 2.1 Unit means a unit as defined by the Condominium Act. 2.2 Unit Owner means unit owner as defined by the Condominium Act. 2.3 Assessment means a share of the funds required for the payment of co~non expenses which, from time to time, are assessed against Che unit owner. 2.4 Association means Orion Isles Condominium Association~ Inc., and its successors. ~ 2.5 By-Laws means the By-Laws of the Association specified above, as t~iey exist from time to time. 2.6 Common Elements shall include the cultivation and irrigation equipment and other tangible personal property required for the maintenance and operation of the condominium, even though it may be owned by the Association, as described in Exhibit "C" hereto attached, as well as the items stated in the Condominium Act. 4a~345 P~E1~'33 MELIILVEII, ME~ROSE 6 DtWOLF, N~NT-~ FLOOR. ~40~ 9RICKEII AVENUE.
