2.7 Common Expenses Include:
a. Expenses of administration, insurance,
maintenance, operation, repair, replacement and better-
ment of the comanon elements and taxes on the common
elements.
b. Expenses declared common expenses by
provisions of this Declaration or the By-Laws.
c. Any valid charge against the condominiwn
property as a whole.
2.8 Condominium means all of the condominium
property as a whole when the context so permits.
2.9 Condominium Act means and refers to the
Condominium Act o~ the 5tate of Florida.
2.10 Declaration, or Declaration of Condominium
means this instrument, as it may be amended from time to time.
2.11 Declarant means Milton H. Hatfield, as Trustee.
2.12 Institutional Mort~a~ee means a bank, savings
and loan association, or insurance company authorized to do
business in the United States of America, an agency of the
United States Government~ a real estate or mortgage investment
trust, or a lender generally recogniaed in the community as
an institutional lender.
2.13 Sin ular, Plural, Gender. Whenever the
context so permits,~e use of the plural shall include the
singular, the singular the plural, and the use of any gender
shall be deemed to include all genders.
2.14 Utility Services as used in the Condominium
Act and as construed wit~ reference to this condominium, and
as used in the Declaration and By-Laws, shall include but
not be limited to electric power, gas, water~ garbage and
sewage disposal.
3. CONDOMINIUM PLAri. The condominium is described and
establishe~ic as ~~ows :
3.1 Survey and Plans. The division of the Land
into separate units is made substantially in accordance with
the survey map as.shown on Exhibit "A" attached hereto and
made a part hereof. Each unit shall consist of an area of
land as described in Exhibit "B" hereto together with the
citrus trees situate thereon.
3.2 Easements.
a. Easements are reserved through the
condaminium property as may be required for utility
services in order to serve the condominium adequately;
b. An easement for ingress and egress is
reserved through Che condaminium property for all unit
owners sufficient to afford each unit owner unrestrained
access to his unit where such access is necessary to
allow said unit owner to follow such citrus caretaking
prodecures as are consistent with good husbandry practices
generally recognized, accepted and in use for citrus
groves located in the vicinity of the land, including,
but not limited to, cultivating, spraying, dusting,
pruning, fertilizing, harvesting, pitching~ irrigating
and protecting trees and crops against damage by freeze,
